A confirmation of cancellation will be sent by email to you within 3- business days. If you do not receive a confirmation of cancellation, please check your billing account information in the member's area of AeroGate if you continue to have difficulty please contact our office as soon as possible and immediately resend a second cancellation notice.    THERE ARE NO REFUNDS FOR MONTHLY MEMBERSHIPS. It is the members responsibility to ensure that AeroGate has received proper notice of cancellation. Three (3), six (6), and twelve (12) month memberships DO NOT automatically renew.

AeroGate  does not warrant the accuracy, completeness, merchantability or fitness for a particular purpose of any of the data in AeroGate   or any service provided herewith. In no event shall AeroGate be liable for any injury, loss, claim, damage, or any incidental or consequential damages (including, but not limited to lost profits, or lost savings) which arises out of or is in any way connected with any listing of any data of AeroGate , and failure or delay including data on AeroGate (including, without limitation, the use of or inability to use Aviation Jobs Online for any purpose), or the performance or non-performance by AeroGate or any affiliated service or function, even if Aviation Jobs Online has been advised of the possibility of such damages, or for any other party. Some states do not allow the exclusion of implied warranties or the limitation or exclusion of liability for incidental and consequential damages, so the above exclusion may not apply to you.

If, notwithstanding the foregoing, AeroGate should be found liable for any loss or damage which arises out of or is in any way connected with any of the above-described functions or uses of Aviation Jobs Online, AeroGate's liability shall in no event exceed, in the aggregate, the subscription fee and service charge for accessing Aviation Jobs Online with respect to which liability is found. In it's sole discretion, in addition to any other rights or remedies available to AeroGate and without any liability whatsoever to use, Aviation Jobs Online at any time and without notice may terminate or restrict user's access to Aviation Jobs Online.

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL AVIATIONJOBS ONLINE OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL,OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL COMMERCIAL DAMAGES OR LOSSES. IN NO EVENT SHALL AEROGATE SYSTEMS, INC. BE LIABLE FOR ANY DAMAGES IN EXCESS OF THE AMOUNTS AEROGATE SYSTEM, INC RECEIVES FROM YOU FOR USE OF THE SYSTEM, EVEN IF AEROGATE SYSTEMS, INC. SHALL HAVE BEEN INFORMED OF THE POSSIBIILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITAION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION. FURTHERMORE, SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.
